You retain ownership of any Content you submit to the Service. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such Content solely for the purpose of providing the Service to you.

7. User Content

You are solely responsible for any Content you submit to the Service, including the contact lists you upload and the information about your business that you give Mailer Mark. You represent and warrant that you have all necessary rights to submit such Content and that it does not violate any third-party rights or applicable laws.

8. AI-Generated Emails and Sending

The Service uses artificial intelligence to write newsletters, cold emails and follow-ups based on the information you give it, and can send them on your behalf.

AI-generated output may contain errors, omissions or inaccuracies. You are responsible for reviewing emails — including offers, prices and claims — before they are sent, or for the settings that allow the Service to send them without your review.

You are the sender of the emails sent through the Service. You are responsible for having a lawful basis to email each recipient and for following applicable laws, such as the GDPR, national e-privacy and marketing rules, and the CAN-SPAM Act. Every marketing email sent through the Service includes a way for the recipient to unsubscribe or opt out, and opt-outs are honoured automatically. We may pause or limit sending that we believe breaks these Terms or harms the deliverability of the Service.

Output generated by the Service is provided for informational purposes and does not constitute legal, financial or regulatory advice.

Customer Data is not used to train public artificial intelligence models or third-party foundation models unless explicitly agreed in writing.

9. Customer Data and Ownership

Customers retain all rights, title, and interest in and to any Content, contact lists, emails, files, and other data submitted to the Service ("Customer Data").

We acquire no ownership rights in Customer Data. By submitting Customer Data, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, analyze, transmit, and display Customer Data solely for the purpose of providing and improving the Service.

10. Confidentiality

We will treat Customer Data as confidential information and will not disclose such information to third parties except as necessary to provide the Service, comply with legal obligations, or as otherwise authorized by the customer.

11. Security

We implement commercially reasonable technical and organizational measures designed to protect Customer Data, including access controls, encryption, monitoring, backup procedures, and security practices appropriate to the nature of the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Capipal Lab AB shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings.

We shall not be liable for the content of emails sent on your behalf, for whether a given email reaches the inbox, or for business decisions made by users based on output generated by the Service.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service shall not exceed the fees paid by the customer to us during the twelve (12) months preceding the event giving rise to the claim.

13. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties or representations regarding the accuracy, completeness, reliability, availability, or suitability of the Service or any output generated by the Service.
